In late March of 2011, Smirnov, 20, drove from British Columbia to Seattle, Washington in to purchase a weapon. Via Armslist.com, a gun website that links gun sellers with potential buyers, Smirnov contacted Benedict Ladera, from Kent, Washington, expressing interest in a Smith & Wesson .40-caliber pistol that Mr. Ladera had posted for sale. Mr. Ladera agreed to meet at a local casino but upon finding out that Smirnov was from out of state -- keep in mind that personal firearm sales to persons from another state is a felony -- increased the price of the handgun from $400 to $600. Smirnov then then drove to suburban Chicago to track 36-year-old Jitka Vesel whom through an online dating service in 2008. He found Vesel's address on the internet, and tracked her to her office by gluing a GPS device to her car, prosecutors say. Based on shell casings found at the scene, Smirnov shot her eleven times, DuPage County State's Attorney Robert Berlin said. That means that he stopped firing at one point to reload the gun and continue shooting.

Five months later, in July of 2011, Demetry Smirnov plead guilty to first degree murder and was sentenced to life in prison. According to suburban Chicago prosecutors, Demetry Smirnov verified that Illinois had banned its death penalty before traveling here to murder his ex-girlfriend. In June of 2012, Benedict Ladera, the 31 year old Seattle-area bartender who sold him the gun, plead guilty to the illegal transfer of a firearm to an out-of-state resident, and was sentenced to a year in prison.

In December of 2012 -- immediately after the Sandy Hook tragedy when anti-gun furor was at its highest, those overly litigious gun control fuckheads at Brady Campaign filed a lawsuit that specifically blames Armslist as being responsible for negligence in facilitating an illegal gun sale. It was filed "on behalf of the family of 36-year-old Vesel, a former Chicago elementary school teacher." Now is it a tragedy that this Jitka chick was killed? Absolutely. Is Smirnov responsible? Hell yes. Is Ladera also responsible? Hell yes. But is Armslist responsible? No, I just don't see it. Try to imagine if you will, you casually browse through Craigslist to go find yourself a hooker. Even though you already know it's illegal, you arrange to meet at a hotel, do the deed, pay and leave. But as an added bonus you also get to take home herpes, which you promptly give to your wife. Angry that she now has cold sores busting out on both sets of lips, your wife then sues... Craigslist? See, that shit doesn't make any sense. Anyway, if you feel so inclined, I strongly urge you to kick in a few bucks to the Armslist's Legal Defense Fund; I know, that's a shitty design but the guy Jon who runs Armslist is a stand up guy. Not to mention if the Brady Bunch gets any traction on this; it could have a chilling effect on online firearm sites.
